02.03.07 - Magna wins victory over anti-social behaviour

Magna has won yet another victory in the fight against anti-social behaviour and has been granted an injunction against a tenant from Bridport after a lengthy battle.

Complaints were made by neighbours as far back as Spring 2004 and despite letters from Magna and visits by staff to the tenant, the complaints still kept coming in.

Some of the things neighbours mentioned were spitting, fighting, dog barking, loud music and door banging, broken windows, swearing, shouting in communal areas, numerous visitors calling at all hours of the day and night and dumping rubbish on the communal landing.

A NOSP (Notice Of Seeking Possession), which is the first stage in legal proceedings, was served June 2006 but still no changes were made and in the end Magna applied for an injunction in January 2007 which was granted this week.

The injunction, which is in force until the end of August, forbids the resident from leaving rubbish in communal areas and causing noise nuisance, or any other annoyance, to other residents in the area. Breaking the terms of this injunction could result in a fine or prison sentence.

Ruth Ashdown, area housing manager for Magna, says, “This is another good outcome for us and sends a message to everyone that they must respect the way other people wish to live.”

She adds, “Although we do all we can to keep people in their homes, we will not tolerate anti-social behaviour, particularly where it impacts on others. We will continue to work with agencies such as the local police and anyone found guility of anti-social behaviour could lose their home as well as being fined or even imprisoned.”

Magna’s drive to stamp out anti-social behavour has been consistent, with a number of actions being taken against problem residents during the last six months including three Acceptable Behaviour Contracts, three injunctions obtained, uisng mediation in three cases and carrying out three evictions.
